Welcome to StayLive (the "Service"). By using our Service, you agree to be bound by the following terms. If you do not agree to these terms, please do not use the Service.

1. Description of Service

StayLive is a hotel status information platform for travelers that provides:

• User-submitted hotel status reports and reviews
• AI-powered hotel status analysis and chat features
• Hotel information aggregation (sourced from Google Places and TripAdvisor)

Important: StayLive does not provide emergency assistance or real-time alert services. This Service is not a substitute for calling 000 (Australia) or other local emergency numbers. If you are in immediate danger, please contact your local police or emergency services immediately.

This Service integrates geographic information provided by Google Maps/Places. By using the Service, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service.

2. Account Registration

You must provide a valid and accurate email address to register an account. You are responsible for maintaining the security of your account, including protecting your password. We are not liable for any loss resulting from your failure to secure your account.

You understand and agree that your email address is the sole credential for accessing your account. If you lose control of your email, StayLive may be unable to recover your account and shall not be liable for any resulting data loss.

3. Subscriptions and Payments

StayLive offers Free, Pro, and Ultra plans. Paid subscriptions are processed through Stripe.

• Subscriptions are billed monthly and auto-renew until you cancel
• After cancellation, you retain access to paid features until the end of the current billing period
• We do not offer refunds for partially used billing periods
• We reserve the right to adjust pricing at any time; price changes take effect at the next billing cycle

4. User Content

Hotel reports, reviews, and other content you submit through the Service ("User Content") remain your property. However, by submitting User Content, you grant StayLive a non-exclusive, worldwide license to display, distribute, and use such content on our platform.

You warrant that your submitted content:

• Is truthful, accurate, and based on your genuine stay experience
• Does not contain defamatory, harassing, hateful, or otherwise unlawful material
• Does not infringe on any third party's intellectual property rights

We reserve the right to remove any content that violates these guidelines without prior notice.

5. AI-Generated Content

The Service uses DeepSeek AI to provide hotel status analysis and chat features, and uses the OpenAI Moderation API for content safety screening of user-submitted reports. Please note:

• AI-generated content may be delayed or inaccurate
• AI analyses are for reference only and do not constitute a guarantee of conditions for any specific hotel
• You should not rely solely on AI analyses for travel decisions
• We are not liable for any loss arising from the use of AI-generated content

6. Prohibited Conduct

When using the Service, you must not:

• Submit false or misleading hotel reports
• Attempt unauthorized access to other users' accounts or our systems
• Use automated tools (scrapers, bots, etc.) to crawl or bulk-access the Service
• Reverse-engineer, decompile, or disassemble the Service
• Use the Service for any unlawful purpose

7. Intellectual Property

The design, code, trademarks (including the StayLive name and logo), and other content of the Service are the intellectual property of StayLive and are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute these materials without express written permission.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the accuracy, completeness, reliability, or availability of the Service.

In particular, we do not guarantee:

• The accuracy or timeliness of hotel information on the platform
• The truthfulness of user-submitted reports
• The accuracy of AI analysis results
• Uninterrupted operation of the Service

9. Limitation of Liability

To the maximum extent permitted by law, StayLive and its team shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service, including but not limited to personal injury, property damage, or data loss.

10. Indemnification

You agree to indemnify and hold harmless StayLive and its team members from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) content you post; (b) your violation of these Terms; or (c) your infringement of any third party's rights.

11. Force Majeure

StayLive shall not be liable for any delay, interruption, or failure to perform its obligations caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power or network outages, or disruptions or failures of third-party service providers (such as DeepSeek, OpenAI, Supabase, or Stripe).

12. Account Termination

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms. You may also delete your account at any time through the settings page. Upon termination, your personal data will be handled in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms shall be submitted to the courts of competent jurisdiction in Victoria.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service constitutes acceptance of the modified Terms.
